By accessing or using WattHive ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our platform or services.

We reserve the right to modify these Terms at any time. Your continued use of our platform after such modifications constitutes acceptance of the updated Terms. We will notify you of material changes by posting the updated Terms on this page.

2. Use of Service

WattHive provides a platform that connects property owners with solar installation companies. Our services include:

  • Matching property owners with solar companies based on location and needs
  • Facilitating communication and quote requests between users and solar companies
  • Providing information about solar companies, including reviews and service areas
  • Offering tools such as solar calculators and educational resources

You agree to use our platform only for lawful purposes and in accordance with these Terms. You may not use our platform:

  • In any way that violates applicable laws or regulations
  • To transmit any harmful, offensive, or illegal content
  • To impersonate any person or entity or misrepresent your affiliation
  • To interfere with or disrupt the operation of our platform
  • To attempt to gain unauthorized access to any part of our platform

3. User Responsibilities

As a user of WattHive, you are responsible for:

  • Account Security: Maintaining the confidentiality of your account credentials and notifying us immediately of any unauthorized access
  • Accurate Information: Providing accurate, current, and complete information when creating an account or requesting quotes
  • Compliance: Complying with all applicable laws, regulations, and these Terms
  • Content: Ensuring that any content you submit is accurate, lawful, and does not infringe on the rights of others
  • Third-Party Services: Understanding that we are not responsible for the services, products, or actions of solar companies you connect with through our platform

4. Solar Company Relationships

WattHive acts as an intermediary platform connecting property owners with solar installation companies. We are not a party to any agreements or transactions between you and solar companies. Any quotes, contracts, or services are solely between you and the solar company.

We do not endorse, guarantee, or warrant the services, products, or performance of any solar company listed on our platform. You are responsible for conducting your own due diligence and making informed decisions when selecting a solar company.

5. Intellectual Property

All content, features, and functionality of the WattHive platform, including but not limited to text, graphics, logos, icons, images, software, and the overall design, are owned by WattHive or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use our content without our prior written permission. You retain ownership of any content you submit to our platform, but you grant us a license to use, display, and distribute such content in connection with our services.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WATTHIVE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR PLATFORM OR SERVICES.

Our total liability for any claims arising from or related to your use of our platform shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

7. Indemnification

You agree to indemnify, defend, and hold harmless WattHive and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of our platform or services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit to our platform

8. Termination

We reserve the right to suspend or terminate your access to our platform at any time, with or without cause or notice, for any reason, including if you violate these Terms. Upon termination, your right to use our platform will immediately cease.

You may terminate your account at any time by contacting us or using the account deletion features in your account settings.

9. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of our platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive any right to a jury trial or to participate in a class action lawsuit.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which WattHive is incorporated, without regard to its conflict of law provisions.
