However, the court decided that the arbitration clause was unfair and rejected the request. Sunnova disagreed and appealed the decision, saying that the arbitrator should decide if the clause is valid and that the McGill v. Citibank rule doesn’t apply.

The Court of Appeal said that Sunnova didn’t bring up the arbitration issue in the initial trial, so they couldn’t discuss it now. They also found the arbitration clause to be unfair in how it was presented and in its content, making it unenforceable.
